One of the first things I learned in my career was that copyright (Law No. 633 of April 22, 1941) arises automatically upon the creation of a work. This means that no formal registration is required to enjoy basic protection. However, it is essential to understand that there are different levels of protection and that copyright protects both moral rights (such as authorship of the work) and economic rights (such as the right to exploit it financially).

Many people use the terms “copyright” and “author’s right” as interchangeable, but there’s actually a small difference, especially in the Italian legal system.
Both serve to protect creative works, but Italian copyright has a special feature: moral rights.
These rights are comparable to the author’s fingerprint on the work; they cannot be erased or transferred to anyone else.

Photographs are a special case in copyright law (SIAE), and I often find myself having to explain this concept.
Every photograph is protected from the moment it is taken. This means that no one can use it without the author’s permission.

Remember that commercial use of a photograph always requires written permission from the copyright holder.
Unfortunately, many underestimate the importance of this aspect, failing to realize that the commercial use of someone else’s image without permission is a violation of the law, with penalties and consequences that can be very severe.

Protezione del proprio lavoro fotografico

Protecting your work begins with knowing your rights.
Always affixing the copyright symbol to your works is a crucial first step. Here are some practical tips:

  • Filigrane e sistemi di protezione: se possibile, utilizzate filigrane o altri sistemi di protezione. Personalmente, preferisco non utilizzarli per preservare l’estetica dell’immagine, ma riconosco che sono uno standard comune, soprattutto per i siti di vendita di fotografie.
  • Metadati IPTC: inserite le informazioni di copyright nei metadati IPTC (autore, contatti, sito web, ecc.) attraverso programmi di grafica o fotografia come Adobe Photoshop, Lightroom, ecc.
  • verifica online: Verificate regolarmente le vostre foto online utilizzando gli stessi software citati prima oppure siti web dedicati come Content Credentials e Compress or Die.
  • Registrazione SIAE: valutate la possibilità di registrare le vostre opere presso la SIAE per una tutela aggiuntiva.

In the event of copyright infringement, it is essential to act promptly. The first step is to carefully document the unauthorized use of the work. A formal warning can be a first step to resolving the situation amicably, but if there is no response, legal action is necessary.

  • Marcare chiaramente le proprie opere.
  • Monitorare regolarmente l’uso delle proprie immagini.
  • Mantenere un archivio delle autorizzazioni concesse.
  • In caso di dubbio chiedere all’autore dell’opera.
